Membership terms and conditions

1. Overview

1.1.  Southbank Centre is offering three (3) Membership types:

  • Member;
  • Member Plus; and
  • Joint Member Plus,

each a “Membership”. By acquiring a Membership, You (and any named Joint Member) become a “Member”.

1.2.You may acquire up to 1 X Membership.  Each Membership has certain Membership rights attached to it. 

1.3. By acquiring a Membership, You confirm that You (and any named Joint Member understand and agree to these Terms and Conditions (“Terms”), which govern Your Membership and explain the benefits, rights, and conditions associated with Your Membership.

 1.4.These Terms incorporate and should be read alongside: (i) Southbank Centre’s Website & Ticket Terms and Conditions; (ii) any specific terms and conditions applicable to a Membership benefit, prize draw, challenge, event or other activity you are informed of from time to time; (iii) Southbank Centre’s Community Guidelines; and (iv) Privacy Policy.

 1.5. References in these Terms to “You” are to the individual who acquired the Membership and to any named Joint Member.

 1.6. Southbank Centre’s obligations and Your rights under the Terms are subject to and limited by Applicable Law.

2. Southbank Centre’s Liability – Key Exclusions and Limitations

 2.1. Without affecting Clauses 2.2 and 2.3 below, if Southbank Centre fails to comply with these Terms, we are responsible for loss or damage You suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by You and by Southbank Centre at the time that You acquired Your Membership.

2.2. Subject to Clause 2.3 below, Southbank Centre shall not have any responsibility or liability to You for any losses, damages, expenses or liabilities you incur in respect of the following:

  • any unauthorised use of the Membership by You or a third party, including any loss or damage caused by Your failure to keep Your Membership Account details secure;
  • actions taken by Southbank Centre as a consequence of Applicable Law;
  • any failure or delay in carrying out any matter in respect of Your Membership caused by circumstances outside of Southbank Centre’s reasonable control; and/or
  • any products and/or services provided by any third party in connection with the Membership and which are beyond the reasonable control of Southbank Centre.

 2.3. Nothing in these Terms excludes or limits Southbank Centre’s liability for:

  •  death or personal injury caused by Southbank Centre’s negligence;
  • fraud or fraudulent misrepresentation; or
  • any matter for which it would be unlawful to exclude or restrict our liability. 
3. Membership Summary and Your Warranties

3.1. To be eligible to acquire a Membership, You must complete any required steps as stipulated on the Website, including making any necessary payment.

3.2. The term of Your Membership will be 12 months from the date it is activated.  However, if You have purchased Your Membership by direct debit, Your Membership will auto-renew for further, consecutive 12 month periods, unless You cancel in accordance with the applicable direct debit terms and conditions (together, the ‘Term’).

3.3. You have the right to upgrade Your Membership type during the Term, however, in such circumstances, You must pay the full difference in price between the cost of Your original Membership and the cost of the upgraded membership type, irrespective of how long is remaining of the then current Term.

 3.4. By acquiring a Membership, You agree that:

  • all information You provided as part of registering and acquiring Your Membership is true and accurate and that You shall keep such information updated in a timely fashion;
  • You will only use Your Membership for Your own personal, non-commercial use;
  • You are permitted to acquire a Membership under Applicable Law;
  • You are not personally subject to, or resident in a country that is subject to, economic sanctions or embargoes;
  • (if applicable) You are authorised to accept these Terms on behalf of any Joint Member and that the Joint Member resides at Your address; and
  • You will not fund the purchase of Membership using funds from anyone that is personally subject to, or resident in a country that is subject to, economic sanctions or embargoes.
4. Membership Benefits

4.1. You are entitled to the benefits associated with Your Membership as may be advertised on the Website from time to time, provided that:

  •  You continue to hold the relevant Membership;
  •  You comply with these Terms and any associated benefit Terms and conditions (as, for example, may stipulated on the Website); and
  •  You present proof of Membership where required by Southbank Centre.

4.2. You acknowledge that limits may apply to the use and availability of certain Membership benefits.

4.3. Southbank Centre reserves the right to vary and/or update the Membership benefits available on the Website from time to time. 

4.4. You may also benefit from exclusive Membership emails (which You may opt out of receiving).

5. Cancelling a Membership

5.1. If You are a consumer who has paid for the Membership subscription yourself, You have a legal right to change Your mind and cancel the Membership contract between You and Southbank Centre within 14 days of entering into the Membership contract without giving a reason. This right, under the Consumer Contracts (Information, Cancellation and Charges) Regulations 2013 (or equivalent local legislation) (the “Regulations”), is explained in more detail below. The cancellation period will expire 14 days from the day on which the Membership contract is entered into.

5.2. This right may not always be available to You in respect of services which have been performed or completed, even if the fourteen (14) day cancellation period is still running (or if You cancel after we have started but not yet completed the relevant services, then You remain liable to pay us for the services provided up until the time you tell us that You have changed Your mind).

5.3. Please note that in the context of the supply of our services, we may deduct from any refund a reasonable and proportionate amount for the supply of any service during the 14 day cancellation period. This amount will be in proportionate to the service that has been supplied. For example, if You have used your Membership to purchase a presale ticket, and/or to access to the Hayward Gallery, Your refund will be prorated and may be zero to reflect the value of the services that have been provided to You.

 5.4. Where Your right to cancel has not been lost, then to exercise the right to cancel, You must inform us of Your decision to cancel Your Membership contract with us by making a clear statement such as “I hereby give notice that I cancel my Southbank Centre Membership contract”. Please also include your full name and address, and the date of Your order.  The easiest way to inform us of your cancellation is by emailing us on  [email protected]. You can also post a letter to us at  ‘Ticket Office, Southbank Centre, Belvedere Road, SE1 8XX.’  

5.5. To meet the cancellation deadline, it is sufficient for You to send Your communication concerning the exercise of Your right to cancel before the cancellation period has expired. We will send you an acknowledgement of receipt by email of your notice to cancel.

 5.6. We will make any reimbursement that is due to You without undue delay, and not later than 14 days after the day on which we are informed about Your decision to cancel this Membership contract using the same means of payment as you used for the initial transaction; you will not incur any fees as a result of the reimbursement.

 5.7. You can obtain further advice about Your right to cancel from Your local Citizens’ Advice Bureau or Trading Standards Office.

6. General Conditions of Membership

6.1. You must use Your Membership in a manner that is consistent with Applicable Law and these Terms.

 6.2. You must not (nor permit anyone else to) do the following:

  • use a Membership for any unlawful purpose;
  • allow a non-member to use or otherwise benefit from Your Membership;
  • use a Membership for any commercial (i.e. non-personal) purpose;
  • acquire a Membership under false pretences, for fraudulent purposes and/or by other illegal or unauthorised means;
  • acquire a Membership using automated means or by using a computer program to simulate human behaviour (i.e. a ‘Bot’);
  • use Your Membership in any manner which violates or infringes the rights of any other person or organisation; and/or
  • engage in any discriminatory, abusive, obscene, harmful, threatening, bullying, harassing, dangerous or other unacceptable behaviour in person or online (including via your Membership social media and/or other online community platforms, including where this would amount to a contravention of Southbank Centre’s Community Guidelines).
7. Privacy and Data Protection

Southbank Centre processes Your personal data in order to administer Your Membership, where this is in our legitimate interests. Such data processing may include analysing Your preferences and providing You with appropriate content. We may also need to share Your personal data with third parties involved in administering and delivering the Membership programme.  Our Privacy Policy contains more information about how Southbank Centre handles Your personal data, the third parties we work with, and Your rights (available on the Website at https://staging.southbankcentre.co.uk/policies/privacy-cookie-policy/).

8. Third party suppliers

8.1. Some Membership services may be made available via third party suppliers.

8.2. You acknowledge and agree that:

  • Southbank Centre shall not have any responsibility or liability to You in respect of any products or services provided by any third party in connection with the Membership and which are beyond the reasonable control of Southbank Centre; and
  • the terms and conditions of relevant third parties shall apply to the provision of their services.
9. Southbank Centre’s Rights

9.1. To the extent permitted by Applicable Law, Southbank Centre reserves the right in its absolute discretion to take any of the following actions without notice and without incurring any liability to You for any damage, loss, or expense that You may suffer as a result:

  • make Membership services available on different platforms and websites from time to time;
  • engage alternative third party service providers in the provision of Membership services from time to time;
  • modify the types, prices and quantities of Memberships available on the Website from time to time;
  • issue additional terms and conditions or amend existing terms and conditions applicable to specific Memberships and/or specific Membership benefits from time to time;
  • decline Your application for a Membership;
  • suspend, withdraw, cancel, or amend any of the Membership benefits that Southbank Centre offers or makes available from time to time, including where this is to comply with Applicable Law or where the benefits were offered or made available other than in accordance with these Terms;
  • run other Southbank Centre loyalty, rewards or membership programmes alongside the Membership from time to time;
  • assign or otherwise transfer Southbank Centre’s rights and obligations under these Terms to another entity in the Southbank Centre group;
  • disqualify You from applying for another Membership or any other product or service offered by Southbank Centre, if Southbank Centre reasonably suspects that You are guilty of any of the actions described in Clause 6.2 above; and/or
  • suspend or cancel Your Membership in accordance with Clause 10 below.
9. Cancelling, suspending or terminating Your Membership

10.1. You may cancel Your Membership and/or request to stop receiving certain Membership benefits by writing to Southbank Centre using the contact details provided in Clause 12 below, however no refund shall be paid unless You cancel pursuant to Clause 5 above and a proportionate refund is payable to You.

10.2. In addition to any other rights or remedies we may have at law or in equity, Southbank Centre reserves the right in its absolute discretion to suspend or terminate Your Membership without notice if Southbank Centre determines or reasonably believes that You have acted in breach of these Terms, including the prohibitions listed in Clause 6.2 above.

10.3. If Southbank Centre, acting in its sole discretion, decides to discontinue the Membership programme, Southbank Centre may terminate Your Membership upon the provision of at least three (3) month’s prior written notice.

10.4. Upon suspending or terminating Your Membership, Southbank Centre reserves the right to immediately and without notice take any of the following actions:

  • close Your Membership account;
  • render any Membership and/or accrued Membership benefits null and void; and/or
  • where termination is due to Your breach of these Terms, deem any Membership transaction or activity that took place as a result of such breach to be void from the date it was undertaken.

10.5. For the avoidance of doubt, Southbank shall not be obliged to offer You a refund or to otherwise compensate You for any unused Membership benefits that are suspended, cancelled, terminated or otherwise become null and void pursuant to this Clause 10.

11. Fees and Charges

Southbank Centre may charge You reasonable fees associated with Your Membership (for example, for the cost of replacing a Membership card). You will be advised of any such fees prior to them being charged.

12. Contact

12.2. Southbank Centre will contact You using the most recent contact details you’ve supplied on the Website. It is Your responsibility to keep Your contact details up-to-date.

13. Consumer Rights

13.1. Nothing in these Terms affects Your rights as a consumer, including Your rights in respect of goods that are not fit for purpose and services that are not carried out with reasonable skill and care.  You can seek advice about Your consumer rights from Your local Citizens’ Advice Bureau or Trading Standards Office (or equivalent consumer protection authority in Your country of residence). 

13.2. If You are resident in the European Union and Southbank Centre directs the Membership to Your country of residence, nothing in these Terms affects your rights to benefit from any mandatory provisions of the local law of your country of residence.

14. Changes to Terms

Southbank Centre reserves the right to change these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms). If You hold a Membership, we will provide you with at least thirty (30) days’ advance notice of any material changes, unless the change is due to a change in law or for security reasons (in which case we may need to change the Terms on shorter notice). 

Where we need to notify You directly of any changes, we will use the contact details You have supplied us.

15. Governing law, enforceability and remedies

15.1. These Terms, including any issue or dispute regarding Your Membership, are governed by English law. 

15.2. Any dispute which may arise under these Terms can be bought to either: (i) the competent English court; or (ii) to the competent court of Your country of habitual residence, provided that Your habitual residence is within the UK or is an EU Member State and Southbank Centre has directed the sale of a Membership to such country.

15.3. If any part of these Terms is deemed to be invalid or unenforceable this shall not prejudice or otherwise affect the validity or enforceability of the remainder of the Terms.

15.4. Any failure or delay by Southbank Centre in exercising any legal right or remedy shall not amount to a waiver of that right or remedy.

16. Definitions

“Applicable Law” means all national and international laws, statutes, regulations, codes of practice and related guidance which applies to You and/or Southbank Centre in respect of these Terms.

“Southbank Centre” means Southbank Centre Ltd, a limited liability company registered under number 02238415 and having its principal place of business at Belvedere Road, London, SE1 8XX, acting as trustee of the charity Southbank Centre, registered with the Charity Commission of England and Wales with number 298909 (together, the Southbank Centre)

“Website” means the official Southbank Centre website, currently accessible at https://staging.southbankcentre.co.uk/

Your use of this website is subject to the following conditions and you should not use this website unless you accept these conditions:

  • The Southbank Centre Limited as corporate trustee of the Southbank Centre accepts no liability to any person for loss or damages incurred as a result of reliance upon material contained at this website.
  • Performance details on the site are subject to change without prior notice. The Southbank Centre accepts no responsibility for the accuracy of information or material accessed through the site.
  • By logging on, you will be assuming all risks associated with use of the site, including risk of your computer, software or data being damaged by any virus which might be transmitted or activated via the Southbank Centre site or your access to it.
  • We are not responsible for the content of any linked sites and the inclusion of any link does not imply any endorsement of that linked site.
  • You will only use this website for personal private use.

Ticket conditions of sale
  • For ticketed events every member of the audience or exhibition visitor must have a valid ticket.
  • Latecomers – admission is not guaranteed although offered wherever possible.
  • Ticket holders consent to the recording and filming of themselves as members of the audience.
  • The Southbank Centre reserves the right to refuse admission or attendance to any patron.
  • Smoking is not permitted in the auditoria, foyers or galleries.
  • Glasses, bottles, cameras and recording equipment, etc. are not allowed in the auditorium.
  • Babes in arms and children under seven cannot be admitted to classical concerts and some other events.
  • Mobile phones, pagers and watches should be silenced before entering the auditorium.
  • The Southbank Centre reserves the right to make any alterations to an advertised programme rendered necessary by unavoidable causes.
  • In some circumstances, tickets can be returned for a credit voucher, valid for one year, or exchanged for another performance. This service is offered to the original purchaser of the tickets only and there is a transaction fee of £3 per ticket.
  • The price of your ticket may include a £2 restoration levy which will be shown as part of your total at checkout. The restoration levy goes towards the upkeep and improvement of our historic venues.
  • For shows where the run finishes 14 days or more after the first performance, we will, strictly subject to availability, offer a same show exchange only. Credit vouchers or other exchanges are not available in these circumstances.
  • All return requests must be made at least 48 hours before the start of the show time originally booked. Under no circumstances do we offer refunds for returned tickets.
  • E-tickets must not be used more than once.
  • Tickets can only be sold by the Southbank Centre or one of its authorised agents. Not complying will make this ticket void.
  • If you resell your tickets for profit or commercial gain and hold a current Southbank Centre Membership, you are liable to lose your Membership benefits.
  • If your tickets are not being held at the venue ticket office, and you have not received your tickets from us 24 hours prior to the event, please contact us.
  •  It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of ordering so that we can provide you with relevant information about or updates to the event.

Your statutory rights are not affected. 

Southbank Centre Under-30s terms and conditions
1. Eligibility and signing-up

1.1. Southbank Centre Under-30s applies to any individual aged 18 – 30 at the time of registration.

1.2. Registration for Southbank Centre Under-30s is free of charge.

1.3. Individuals who register will receive email updates about upcoming exhibitions, events, and content from the Southbank Centre.

2. Southbank Centre Under-30s benefits and ticket purchase

2.1. The scheme provides half-price tickets to Hayward Gallery exhibitions and discounts for selected Southbank Centre events, alongside selected deals on food and drink at the Southbank Centre.

2.2. Discounted tickets are limited to two tickets per person for each event.

2.3 If another person aged 30 or under wishes to attend with a discounted ticket, they must register for Southbank Centre Under-30s separately. They cannot use your discount.

2.4 Tickets purchased through the scheme cannot be exchanged or sold.

2.5 The Southbank Centre reserves the right to vary and/or update the Under-30s benefits available on the website from time to time. 

2.6. You may also benefit from exclusive Under-30s emails (which you may opt out of receiving).

3. Event admittance

3.1. Each booker attending an event with an Under-30s discounted ticket must present three items for admittance:
* 3.1.1. Their digital Under-30s scheme card (on a mobile device).
* 3.1.2. Their PDF ticket.
* 3.1.3. Their photo ID.

3.2. Entry might be refused to those who do not present a valid digital Under-30s scheme card.

3.3 In addition, guests with an Under-30s ticket who did not book must attend with the booker, and bring their PDF ticket and their photo ID.

4. Southbank Centre Under-30s termination

4.1. Once a member reaches the age of 31, they are no longer eligible for this scheme.

4.2. At this point, the member will be automatically removed from the Southbank Centre Under-30s mailing list and their digital card will expire.
